MP HC issues notices to BJP Min, Cong leader


Jabalpur, MP:  The Madhya Pradesh High Court today issued notice to Water Resources, Public Relations and Parliamentary Affairs Minister Narottam Mishra on a petition over the non-declaration of Datia constituency as vacant in spite of his election being declared void by the Election Commission of India (ECI). Hearing a petition filed by journalist Surendra Dubey, a division bench of Justice Hemant Gupta and Justice VK Shukla also issued notice to Congress leader Rajendra Bharti – on the basis of whose petition, the EC disqualified Mr Mishra from contesting elections for the next three years and declared his election void. The court directed to make Mr Bharti a non-applicant in the case and fixed the next date of hearing on July 11. Citing Article 190 (3) of the Constitution, the petitioner told the court that a seat is declared vacant if a certain candidate is declared ineligible. In spite of the provision in this regard in the Constitution, the Governor, Principal Secretary (Law) and the EC did not initiate steps to declare the seat as vacant. The government’s counsel told the court that Mr Mishra’s has moved the High Court’s Gwalior Bench against the court order and the matter is sub-judice. The next date of hearing in that case was fixed in July 10.
