HP High Court directs authorities to remove encroachment from govt land

High Court of Himachal PradeshShimla, Jul 14 - Himachal Pradesh High Court today ordered that no one should be allowed to give slip to the law and order in the state directing all authorities to expeditiously remove all encroachment from the government land. Division Bench of Chief Justice Mansoor Ahmad Mir and Justice Tarlok Singh Chauhan said in an order passed on a public interest litigation over encroachment of lands by large number of people for the orchards that no one should be allowed to give slip to the land and order in the state ensuring that all concerned authority did not buy time to supply records of forest properties to evict the encroachments from it. While considering the plea of forest department that more revenue officers should be posted to provide the detail of state and forest properties to take further action, counsel for Irrigation and Public Health, state Electricity Board and forest department informed the bench that they were removing encroachment and disconnecting the water, and power supply to errant in phased manner, as they are depended upon the revenue officers for ascertaining the fact before taking action on the complaints. "In the given circumstances, we deem it proper to direct all the authorities concerned which are directly or indirectly monitoring all the forests land or forest properties, which is subject matter of the writ petition that in case, any request, which is lawful, is made by any of the party or parties to any department, such request be acceded to, without wasting time, so that, any party or parties may not give slip to the law or to the orders passed by this Court," the court order said. The court fixed the hearing on August 3, 2015 and directed all parties to file their respective status report on direction issued by the court to evict encroachment and disconnect power and water connection supplied to the encroacher.
