Courts orders FIR against builder, JDA officials for criminal conspiracy

8663789129_86c00ef963_bJaipur, Jul 14 - Additional Chief Metropolitan Magistrate court (ACMM) in Jaipur today directed the Shyam Nagar police to file FIR against former Jaipur Development Commissioner (JDC) Devendra Bhushan Gupta, Chief Town Planner Lavang Sharma, ex-Deputy Commissioner Iqbal Khan and Manglam Builders proprietor N K Gupta and his son Sanjay Gupta for cheating, forgery and criminal conspiracy. The court has issued the order on a complaint by RTI activist Dr Sanjiv Gupta today. Senior counsel A K Jain appeared for the petitioner. The petitioner alleged that Manglam Builders in connivance with the JDA officials have constructed 10 storey commercial complex named ‘Mangalam Metropolis’ at Purana Chungi on Ajmer Road showing the road in front of the building as 60 feet while the road size was only 30 feet. The petitioner said in the registry as well as in the map the road was clearly stated as 30 feet but the builders have forged documents to show that it was 60 feet. The petition said as per the building by law on 30 feet road not building height is limited 15 meters. But Sanjay Gupta in connivance with the JDA officials had found a way out by leaving 30 feet extra from his land for road in his portion of the land and obtained sanction for the building with a height of 25 meters. The petitioner said this is not permissible as the road width is measured from one end to the other end and no building could be sanctioned by this way and the JDA officials were also guilty of criminal conspiracy by giving permission. The court thus directed to register an FIR under section IPC 420(cheating and dishonesty, (467) forgery of document, forgery for the purpose of cheating (468) criminal conspiracy against these people (120b).
