Bihar government deliberately delayed filing of SLP in SC:BJP



 Patna :  Bihar BJP today maintained that Nitish Kumar government deliberately delayed filing of Special Leave Petition (SLP) in Supreme Court for challenging grant of bail to RJD strongman Mohammed Shahabuddin to keep RJD Chief Lalu Prasad in good humour. Former Deputy Chief Minister and senior BJP leader Sushil Kumar Modi told media here that the state government did not file SLP in the Supreme Court until noted advocate Prashant Bhushan filed a petition in the apex court to challenge grant of bail to Mr. Shahabuddin by Patna High Court recently. He said that Chief Minister knew very well how important Mr. Shahabuddin was for the RJD Chief and so he avoided taking the plunge and waited for Mr. Bhushan to file the petition in the Supreme Court first. Mr. Modi said that when Mr. Bhushan filed the petition in the Supreme Court, state government fount it better to file the SLP in the apex court to save itself from embarrassment as it was then bound to reply to notices which would have been issued by the court during the hearing of the petition for bail cancellation. He said that Patna High Court had granted bail to Shahabuddin on March 2 this year in connection with the killing of two siblings-Satish Raj and Girish Rash due to acid bath. “State government ought to explain whether it was waiting for a person like Prashant Bhushan to challenge Shahabuddin`s bail in the Supreme Court”, Mr. Modi said. Mr. Modi said that the state government lacked courage to take direct action against Shahabuddin and so it kept waiting for person like Prashant Bhushan and CBI to take action against the RJD strongman. He said that Chief Minister wanted other to take steps against leaders with criminal antecedents so that his government remained unscathed. He said that when Mr. Kumar was Chief Minister during NDA regime,, he wanted to field wife of Mr.Shahabuddin in election on JD (U) ticketbut he had to retract his step after BJP objected to it. He said that Mr. Kumar had no problem with Mr. Shahabuddin but he was only annoyed over his statement that he did not consider him as his leader. He said that Chief Minister should tell whether the state government would lift all cases lodged against Shahabuddin if he accepted his leadership.
