Alld HC terminates assembly membership of SP member in UP



Lucknow : The Allahabad High Court today terminated the Uttar Pradesh assembly membership of ruling Samajwadi Party MLA Ram Singh from Patti assembly segment of Pratapgarh district following irregularities during counting of votes in March 2012 Assembly elections. The decision for terminating the Assembly membership of the MLA was given by a single bench comprising Justice A N Mittal here. The court while terminating the membership also directed strict action against the district officials concerned who were involved in the irregularities. In the 2012 assembly elections in the state, BJP candidate Rajendra Pratap Singh alias Moti Singh was defeated by SP nominee Ram Singh by a slender margin of 156 votes in the Patti assembly segment of Pratapgarh district. The decision was given on an election petition filed by Moti Singh, a three-time MLA and a former UP minister alleging that postal ballots were not counted. The petitioner claimed that 955 votes were received through postal but the authorities did not count it intentionally leading to his defeat . However, the district authorities defended their action saying that the postal ballots were not received in 13A envelope hence it was not counted. But the court rejected their contention.
